UNIFORM DOMAIN NAME DISPUTE RESOLUTION POLICY: CRITICAL ANALYSIS

The technological evolution has resulted in a massive increase in the number of domain names registered. With the ‘.com’ bubble burst, there has been an uptick in domain name disputes, resulting in anarchy in this niche of intellectual property. The Uniform Domain Name Dispute Resolution Policy of the Internet Corporation for Assigned Names and Numbers is an international dispute resolution procedure that permits trademark holders to sue the registrant of an Internet domain name, have the name adjudicated, and take control of the name if the challenge is successful. In October 1999, the policy was established, and the first case was determined in December 1999. The Uniform Domain Name Dispute Resolution Policy has made tremendous progress in resolving domain name disputes since its inception. This paper critically evaluates the Uniform Domain Name Dispute Resolution Policy (UDRP), registration process of domain name, domain name disputes and some suggestions have been given for the improvement of UDRP.Downloads
